                                    Islam, Democracy and Human Rights in Contemporary Indonesia139Article 47 of Government Regulation No. 28 of 2022 states:%u201cThe prevention from leaving the territory of Indonesia may becarried out by issuing a new decision after the extension of theprevention, as referred to in Article 46 paragraph (4) expires.%u201dThis article is considered to be in serious contradiction withthe principles and universal norms of human rights (HAM) thatare embodied in the 1945 Constitution of the Republic ofIndonesia (UUD 1945) and all applicable laws and regulations.The following are several arguments that demand an immediatejudicial review of the regulation to ensure it does not violateuniversal and fundamental principles of law and human rights.Various ContradictionsThe substance of Article 47 of Government Regulation No.28 of 2022 appears to contradict universal human rightsprinciples and the Constitution%u2014particularly Article 28Dparagraph (1) of the 1945 Constitution, which states:%u201dEvery person shall have the right to the recognition,guarantee, protection, and fair legal certainty, and equaltreatment before the law.%u201dPreventing someone from traveling abroad for an unlimitedperiod without explicit restrictions violates the principles of legalcertainty and the protection of constitutional rights.Likewise, the right to travel, including the right to go abroad,is also a human right, as guaranteed under Article 28E para-
