Asupportive national legal code is necessary for this purpose. Inorder for a national legal code to be successful it must bringtogether established legal principles which are both recognizeand accepted in national and international trade. A nationallegal code should provide legal certainty, order, enforce-abilityand legal protection based on the core elements of justice andtruth. Such a law will support growth and development of thenational economy and help to achieve the goals of nationaldevelopment.One legal instrument which is necessary to support development of the national economy is a law on bankruptcy. A goodlaw on bankruptcy will assist economic recovery; recovery willbe much slower without it. We have a law concerningbankruptcy, including suspension of payment (Faillisementverordening Staatsblad 1905-217 juncto 906-348). This is a lawwhich we inherited from the Dutch Indies Government (HindiaBelanda). However, it was drafted to deal with the businesscircumstances which applied at that time and does not provideadequate solutions to the problems which occur in Indonesiatoday because of the financial crisis. It follows that theBankruptcy Law should be amended, by making changes,adding new provisions and eliminating provisions which areno longer necessary or suitable in current circumstances. Thisis particularly the case in respect of debt service and enforcementproblems.Amendment of the Bankruptcy Law has been effectedthrough Government Regulation in lieu of Law No. 1 of 1998
